of the Code of Criminal Procedure, 1973 for grant of regular bail in a case FIR No.350 dated 23.07.2018, registered at Police Station Baldev Nagar, District Ambala, under Sections 21 and 22 of the NDPS Act, 1985. Notice of motion was issued in this case. Learned State counsel put in appearance on behalf of the respondent-State and contested this petition.
I have heard learned counsel for the petitioner as well as learned State counsel and gone through the record. From the record, I find that in the present case, 20 injections (2 ML each) of OMGESIC, containing the salt of Buprenorphine, were PARVEEN KUMAR 2019.07.03 18:14 I attest to the accuracy and integrity of this document
CRM-M-15467-2019 recovered. The aforesaid recovery falls in commercial quantity. Section 37 of the NDPS Act, 1985 bars the grant of bail to the accused in case of commercial quantity.
In view of the above, I do not find it a fit case where the petitioner is entitled to the benefit of regular bail. Therefore, finding no merit in the present petition, the same is dismissed.
