IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CRM-M-29551 of 2018 Date of Decision: 02.08.2018 Abhishek ....Petitioner

Versus

State of Haryana ....Respondent CORAM: HON'BLE MR. JUSTICE RAMENDRA JAIN Present: - Mr. A.K. Malik, Advocate, for the petitioner. Mr. Yashwinder Singh, DAG, Punjab.

RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner Abhishek in a case arising from FIR No.172 dated 17.02.2018 registered under Sections 323, 341, 379-B and 34 IPC at Police Station Chandni Bagh, Panipat, District Panipat. According to the prosecution, in the night of 16.02.2018, petitioner along with his three accomplices with muffled faces, caused injuries to the complainant with danda, fist blows, snatched his mobile phone and Rs.10,000/- in cash.

Learned counsel for the petitioner inter alia contends that no recovery has to be effected from the petitioner. He is in custody since 18.02.2018. Conclusion of trial may take a sufficient long time. No useful purpose would be served by keeping the petitioner behind bars. Learned State counsel has vehemently opposed the grant of regular bail to the petitioner.

Considering overall facts and circumstances, but without Ravinder Singh 2018.08.03 16:36 I attest to the accuracy and authenticity of this document expressing any opinion on the merits of the case, the petition is allowed.

-2CRM-M-29551 of 2018 Consequently, petitioner is ordered to be released on bail, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
