**** ANITA CHAUDHRY, J(ORAL) The petitioner is seeking regular bail in FIR No. 35 dated 30.4.2016 registered at Police Station Women Kaithal, District Kaithal under Sections 365, 328, 376-D, 506 IPC.

The petitioner is in custody since 7.5.2016. Challan has been presented and the charge has been framed. The petitioner was not named in the FIR nor in the statement recorded under Section 164 Cr.P.C. His name appeared in the second supplementary statement made under Section 164 Cr.P.C. The petitioner has placed on record the call details between the petitioner and the prosecutrix even after the incident. The State counsel also does not dispute that fact.
