CRM-M-28634-2017(3 cases) -2438 Code of Criminal Procedure (for short-Cr.P.C.) for grant of anticipatory bail to the petitioners in case FIR No.226 dated 17.04.2016 registered for the offences punishable under Sections 147, 148, 342, 302, 201, 506 read with Section 149 of Indian Penal Code, at Police Station Sadar Bhiwani, District Bhiwani.

Heard.

Learned counsel for the petitioners submit that petitioners have surrendered before the trial Court and have been allowed interim bail in terms of orders dated 08.08.2017, 16.08.2017 and 17.08.2017 respectively. Learned State counsel submits that petitioners during investigation were found innocent by the police and have been summoned by the trial Court on the application under Section 319 Cr.P.C. filed by the prosecution.

Keeping in view the fact that trial of the case is in progress and custodial interrogation of the petitioners is not required, all these petitions are allowed. Order dated 08.08.2017 passed in CRM-M-28634-2017, order dated 16.08.2017 passed in CRM-M-29521-2017 and order dated 17.08.2017 passed in CRM-M-29811-2017 are made absolute, subject to the condition that petitioners shall appear before the trial Court on each and every date of hearing. In the event of their non-appearance on any date without permission, the trial Court will be competent to cancel their bail and forfeit the bail bonds and surety bonds and to take the petitioners in custody.
