(Oral) After arguing for sometime, when this Court was not inclined to accept the submissions made on behalf of the petitioner qua the quashing of the complaint along with summoning order, learned counsel for the petitioner submits that he does not want to press the instant petition.

However, a prayer has been made by learned counsel for exemption of the petitioners from personal appearance before the Trial Court.

Personal appearance of petitioners is exempted before the Trial Court. However, the exemption qua personal appearance of the petitioners shall be subject to the following conditions:- (i) That the counsel for the petitioners would appear on each and every date of hearing and will not delay/stall the proceedings in the trial Court.

(ii) That the petitioners will not raise any dispute qua his identity as an accused and also not raise any objection, SONIA BURA 2024.04.09 11:13 I attest to the accuracy and integrity of this document

(iii) That no dispute will be raised by the petitioners qua the identity of the witnesses examined in his absence. (iv) That an undertaking shall be given by the petitioners before the trial Court that he would put in appearance as and when called upon to do so by the trial Court. (v) Any other condition that may be imposed by the trial Court.

Accordingly, the present petition stands dismissed as not pressed.
