(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No.131 dated 19.10.2019, registered at Police Station Phase 11, S.A.S Nagar, District Mohali, who has been booked for having committed the offence punishable under Section 406/420/465/467/468/471/474/170/120-B of IPC. Learned counsel for the petitioner submits that the allegations in the FIR are that the complainant had paid approximately Rs. 1 crore to petitioner and his wife between the year 2002 to 2015 for purchasing of property. However, the documents which had been handed by the wife of the petitioner to the complainant were found to be forged and fabricated. Learned State counsel on instructions from ASI Nirmal Singh submits challan has been presented and charges have been framed. Further the wife of the petitioner had been released on interim bail due to her deteriorating health condition.

Crl. Misc. No. M-15308 of 2020 -2Learned counsel for the petitioner submits that the petitioner is ready to give the surety up to Rs.50 lacs. A bare perusal of order dated 03.06.2020 shows that the bail of the petitioner has been rejected on the ground that a huge amount i.e more than Rs. 1 crore is involved, which is to be recovered from the petitioner and his wife.

Petitioner is in custody since 30.10.2019.
Keeping in view the fact that the trial is likely to take some time to conclude, the present petition is allowed. Petitioner is ordered to be released on bail during pendency of the trial of the present case, subject to his furnishing surety of Rs. 50 lacs in the form of property papers for surety/bank guarantee to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Mohali.
