RAMENDRA JAIN, J. (ORAL) Case has been taken up for hearing through video conferencing due to pandemic Covid-19.

Through this petition under Section 439 Cr.P.C., petitionerNarinder Kumar, has prayed for grant of regular bail in case FIR No. 465 dated 10.10.2019 registered under Sections 148, 149, 323, 427, 455, 379B, 307, 302, 506 and 120-B IPC at Police Station Sadar Thanesar, District Kurukshetra.

Learned counsel for the petitioner inter alia contends that material prosecution witnesses, namely; PW-2-Vijay, PW-7 Manjeet Singh and PW-11 Anshul Jasuja, have not supported the prosecution story. Petitioner is in custody since 13.10.2019. Conclusion of trial may take long time. No useful purpose would be served by detaining him in jail.

CRM-M-15278-2020 -2On the other hand, learned State counsel vehemently opposed the submissions of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of case, the petition is allowed. Consequently, petitioner-Narinder Kumar, is ordered to be released on bail pending trial, if, not required in any other case, on his furnishing adequate bail and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
