SURINDER GUPTA, J.(Oral) The petitioners have filed this petition under Section 482 Code of Criminal Procedure (for short, 'Cr.P.C.') seeking quashing of FIR No.48 dated 02.04.2017 (Annexure P-1) along with all consequential proceedings arising therefrom, registered for offences punishable under Sections 323, 365, 328, 406 read with Section 120-B of Indian Penal Code (for short 'IPC') at Police Station Division no. 2 District Pathankot, on the basis of the compromise (Annexure P-2).

Heard.

Report of the trial Court has been received, wherein after recording statements of petitioners and respondent no. 2, it has been observed that compromise between petitioners and respondent no. 2 is genuine and voluntary.

Learned counsel for petitioners submits that this case is outcome of matrimonial discord between petitioner no. 1 and respondent Jitender Kumar 2017.10.31 16:55 I attest to the accuracy and integrity of this document CHANDIGARH

CRM-M-28728 of 2017 -2no. 2. Now the matter has been amicably settled and under the settlement respondent no. 2 has filed a divorce petition. As per compromise between petitioners and respondent no. 2, they have agreed to end their matrimonial relations.

Keeping in view the report of learned Additional District and Sessions Judge, Pathankot and facts as submitted by learned counsel for petitioners, which are endorsed by learned counsel for respondent no. 2, the instant petition is allowed and impugned FIR No. 48 dated 02.04.2017 (Annexure P-1) registered at Police Station Division no. 2, District Pathankot along with all consequential proceedings arising therefrom, qua petitioners, is quashed.
