This is a petition under Section 439 Cr.P.C. preferred by Baljinder Singh @ Happy, seeking grant of bail in case FIR No.115 AVIN KUMAR 2016.03.01 16:40 I attest to the accuracy and integrity of this document

Crl. Misc. No.M-2960 of 2016 2 dated September 30, 2014 under Sections 302, 148, 149 IPC, registered at Police Station, Sarai Amanat Khan, District Tarn Taran. 2.

Undisputably, in the FIR registered at the instance of Manjit Singh son of Resham Singh, resident of House Baba Deep Singh Avenue Sun Sahib Road, Charhata near ITI Collector Charhata, Amritsar, neither the petitioner was named nor any role was attributed to him. However, subsequent thereto, supplementary statement was got recorded by complainant - Manjit Singh, in which, he unfolded the name of petitioner. But even in the said supplementary statement, there is no specific role attributed to him. The petitioner is in custody since October 30, 2014 and disposal of the trial would take sufficient long time.

Taking into consideration the aforesaid aspects of the case but without expressing any opinion on merits of the case, this Court deems it appropriate to extend the benefit of regular bail to the petitioner. Accordingly, instant petition is allowed. Petitioner is ordered to be released on bail on furnishing of personal/surety bonds to the satisfaction of the Trial Court/ Duty Magistrate. 4.

It is further made clear that any observation made in this order shall have no bearing on the trial.
