(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No.145 dated 10.05.2020, registered at Police Station Sadar, District Amritsar, who has been booked for having committed the offence punishable under Section 307/323/336/188/270/ 148/149 of IPC and Sections 25/27 of Arms Act. Learned counsel for the petitioner submits that the allegations in the FIR are that the complaint and his friend Gurpal Singh @ Sagar had received injuries from the hands of the accused. However, as per F.I.R, the petitioner was not armed with any weapon nor any injury has been attributed to him.
Learned State counsel on instructions from SI Bharat Bhushan submits that no firm arm injury has been attributed to the petitioner. He was only present along with the accused who had caused injuries to the complainant and his friend. Crl. Misc. No. M-15367 of 2020 -2investigation is going on and some accused are still to be arrested. Heard.
Petitioner is in custody since 11.05.2020.
Keeping in view the fact that the trial is likely to take some time to conclude and the fact that no injury has been attributed to the petitioner, the present petition is allowed. Petitioner is ordered to be released on bail during pendency of the trial of the present case, subject to his furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Amritsar.
