This is a third petition preferred by petitioner under Section 439 Cr.P.C. seeking bail in case FIR No.03 dated January 08, 2015 under Sections 364, 302, 382, 34 IPC registered at Police Station, Thermal (SGN Dev. TRML Plant), District Bathinda.

Earlier, petitioner filed two petitions viz. CRM No.M-41827 of 2015 and CRM No.M-24495 of 2016 which were dismissed as withdrawn after arguing the matter vide orders dated February 16, 2016 and August 08, 2016, respectively. The instant petition being the third petition having been filed on the same cause of action itself is not maintainable as no fresh argument has been raised. Moreover, petitioner alongwith his co-accused has Avin Kumar 2017.09.28 11:20 I attest to the accuracy and integrity of this document

Crl. Misc. No.M-28765 of 2017 [2] been attributed extortion of motor cycle, mobile phone and murder of Prabhdeep Singh in connivance with each other. Allegations against the petitioner are serious and grave.
