Parkash Singh v. State Of Punjab
In the High Court of Punjab and Haryana, at Chandigarh Criminal Misc. No. M-28768 of 2017 Date of Decision: 08.08.2017 Parkash Singh ... Petitioner(s)
Versus
State of Punjab ... Respondent(s) CORAM: Hon'ble Mr. Justice Shekher Dhawan.
Present:
Mr. Inder Pal Singh, Advocate for the petitioner(s).
Shekher Dhawan, J.
Present petition under Section 438 Cr.P.C. for grant of pre-arrest bail to the petitioner in case FIR No. 76 dated 17.7.2015, registered under Sections 324, 326 & 34 IPC at Police Station Chabhal, District Tarn Taran. Learned counsel for the petitioner contended that petitioner has been falsely implicated in this case because of land dispute and the police had not taken any action on the complaint filed from the petitioner's side as his mother and brother had also sustained injuries. Moreso, there is a delay of 22 days in recording of FIR.
Having considered the submissions made by learned counsel for the petitioner and the fact that the petitioner had allegedly caused injury with the sword and he is main accused in this case, there is no ground to grant the concession of pre-arrest bail to him. Thus, the present petition stands dismissed.
