H. S. Madaan, J. (Oral) Learned State counsel submits that out of 29 witnesses cited, 23 witnesses had been examined though wife of the deceased is yet to be examined.

The trial Court is directed to make earnest efforts to conclude the evidence of the prosecution by the next date of hearing which is stated to be fixed for 30.10.2017. If for any reason the trial Court is unable to examine all the remaining prosecution witnesses on the date fixed, then it would fix another date of about two weeks and on that date the remaining prosecution witnesses would be examined. Thereafter recording statement of accused and examining the witnesses produced by him, the trial be concluded by 30.11.2017 positively. Faced with such situation, learned counsel for the petitioner, states that he be permitted to withdraw the present petition, however, he may file fresh one if need be in accordance with law.
