(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No. 21 dated 02.04.2016, registered at Police Station Kot Dharmu, District Mansa, who has been booked for having committed the offence punishable under Sections 306/34 IPC. The allegation against the petitioner is that he instigated his wife to commit suicide. Otherwise, the marriage of the petitioner was solemnized with his wife-deceased 15 years back and before the present incident, no complaint was made against the petitioner and his family with regard to harassment.

Learned State counsel on instruction has informed that in the trial, an application under Section 319 Cr.P.C has been moved by the prosecution on 17.10.2016 against other accused. The petitioner is in custody since long.

Crl. Misc. No. M-29655 of 2016 -2Keeping in view the fact that the prosecution has moved application under Section 319 Cr.P.C, the trial will take some long time and thus, this Court feels that there is no need to detain the petitioner any longer.

Accordingly, the present petition is allowed. Petitioner is ordered to be released on bail during pendency of the trial of the present case, subject to her furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Mansa.
