The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No.2 not to approve election notification dated 08.03.2026 as letter dated 27.02.2026 issued by respondent No.2 stands withdrawn. Respondent No.2 may be further directed to defer notification dated 08.03.2026 till conclusion of election process initiated by Adhoc Committee. 2.
The instant petition relates to election of Trade Union and recognition of its outcome by Labour Commissioner-cum-Registrar, Trade Unions, Haryana. The petitioner is claiming that it is representing Adhoc Committee which was constituted to conduct election of the Union. The private respondents have illegally conducted elections and served notification dated 08.03.2026 upon respondent No.2-Labour DEEPAK BISSYAN 2026.03.13 18:02 I attest to the accuracy and integrity of this document
CWP-7634-2026 -2Commissioner-cum-Registrar, Trade Unions, Haryana. The Labour Commissioner vide letter dated 27.02.2026 addressed to respondent No.3-Ramesh Tanwar directed the Union to conduct election its office bearers. In the said letter, respondent No.3 was treated as State President. Respondent No.3 conducted election on 08.03.2026. Respondent No.2 on 05.03.2026 withdrew its letter dated 27.02.2026. The parties, on the earlier occasion, approached Civil Court. The Civil Suit was withdrawn on 31.01.2026 on the ground that one Adhoc Committee has been constituted on 17.11.2025 which will issue notification for the proposed election.

Learned counsel for the petitioner submits that Labour Commissioner may be estopped from approving notification dated 08.03.2026 served by respondent No.3.

There is dispute between petitioner and private respondent with respect to election of Union. It is a purely private dispute between two groups of the trade union. They on the earlier occasion have approached Civil Court. They time to time have further approached Labour Commissioner. It shows that they have effective and alternative remedies still have approached this Court by way of present petition. There seems no reason to invoke writ jurisdiction. 5.
Dismissed with liberty to petitioner to approach Labour Commissioner for the redressal of its grievances. 6.
