The petitioner had stood surety for accused Bharat Sidhu for getting him released from custody after he had been granted the concession of bail by the High Court. The title documents and jamabandi, presented by the petitioner along with the affidavit, were found to be forged on verification. No doubt, all the documents have been taken into possession by the investigating agency but in view of apparent fraud having been played with the court, no extra ordinary exceptional circumstances exist to grant him the concession of pre-arrest bail. The circumstance of all the documents having been recovered,may constitute a good ground for grant of regular bail but no ground is made out to grant him the concession of pre-arrest bail.
Dismissed Nothing said in this order will prejudice the right of the petitioner to seek the concession of regular bail by surrendering before the Illaqa Magistrate. In case the petitioner surrenders before the Illaqa Magistrate within a period of one week, his application for regular bail will be decided expeditiously, preferably within two days.
