M.M.S. BEDI, J. (ORAL) Petitioners, on the basis of compromise, seek quashing of FIR No.49 dated 9.7.2013, under Sections 323, 452, 336, 148 & 149 IPC, besides Sections 25 & 27 of the Arms Act, registered at Police Station Sadar, Muktsar, District Sri Muktsar Sahib. The said FIR was registered at the instance of respondent No.2 Jeet Singh alleging that the petitioners along with unidentified persons had trespassed in the house of the complainant and assaulted him with weapons. Petitioner No.1 had allegedly fired shots hitting none.

The parties after having entered into compromise

CRM-M-31576-2013 (O&M) pursuant to the directions of this Court appeared before the Illaqua Magistrate and got their statements recorded regarding the matter having been compromised voluntarily without any threat, coercion or undue influence. In this context, a report has been received from the Additional Chief Judicial Magistrate, Sri Muktsar Sahib. Following the judgment in case Kulwinder Singh and others Vs. State of Punjab, 2007(3) RCR (Crl.), Page-1052, the petition is allowed. The above said FIR and all the criminal proceedings emanating therefrom are hereby quashed on the basis of compromise subject to the petitioners depositing a sum of Rs.10,000/- with the Punjab State Legal Services Authority and another sum of Rs.5,000/- with the Punjab Police Welfare Fund, Sector 9, Chandigarh, within a period of one month.
