Present:

Mr. M.S. Basra, Advocate for the petitioner.

Mr. Shilesh Gupta, Addl. A.G. Punjab.

Mr. Amit Gupta, Advocate for Mr. Vipin Mahajan, Advocate for the complainant. RAJAN GUPTA J.

This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No. 70 dated 19.12.2014 under sections 307, 452, 326, 324, 323, 506, 148 & 149 IPC at Police Station Qadian district Gurdaspur. Learned counsel for the petitioner contends that allegation against the petitioner is that he entered the house of the complainant and inflicted two blows with a sharp edged weapon, one on the head and the other on thumb of left hand. Both the injuries were declared dangerous. Petitioner is in custody since 22.03.2015. State counsel submits that seven prosecution witnesses have been examined and trial is in progress. Keeping in view facts and circumstances of the case, I am of the considered view that no useful purpose would be served by detaining him in custody any longer. CRM M-28776 of 2015 any opinion on the merits of the case, I deem it appropriate to grant regular bail to the petitioner. Accordingly, petition is allowed and petitioner is ordered to be enlarged on bail to the satisfaction of trial court.
