() *$ + , -./'0 It may be noted that the first petition bearing CRM-M-60122-2022, seeking similar relief on the same basis has already been withdrawn by the petitioner on dated 13.01.2023, when the following order was passed :- " Prayer in the present petition, filed under Section 438 of the Cr.P.C. is for grant of anticipatory bail to the petitioner in case FIR No.129 dated 15.11.2022 registered under Sections 419, 420, 465, 468, 471 and 120-B of the Indian Penal Code, 1860, at Police Station Badhni Kalan, District Moga (Annexure P-1).

CRM-M-17120-2023 -2Status report by way of affidavit dated 13.01.2023 of Manjit Singh, PPS, Deputy Superintendent of Police, Nihal Singh Wala, District Moga has been filed on behalf of the State in the Court today. The same is taken on record, subject to all just exceptions. A copy of the same has been handed over to the learned counsel for the petitioner. After arguing for some time, learned counsel for the petitioner wishes to withdraw the instant petition. Dismissed as withdrawn."

A perusal of the second petition would reveal that the averments made therein are primarily the same as contained in first petition (Annexure P-6) and no new circumstance has been put forth. Once the similar petition (CRM-M-60122-2022), having same grounds, has already been dismissed by this Court vide order dated 13.01.2023, there is no ground to grant indulgence in this petition as no new/changed circumstance has been put forth.
