(ORAL) This writ petition has been filed by the petitioner being aggrieved by an order dated 22.04.2022 (Annexure P-2) by which his contract for lifting of wheat from the grain markets during the Rabi season 2022-2023 has been cancelled.
Learned counsel for the petitioner submits that he has been performing his part of the contract diligently and has not made any default in respect whereof the impugned order dated 22.04.2022 has been passed. He further submits that the petitioner even as on date undertakes to lift the gunny bags containing wheat from mandi within 72 hours.
Be that as it may, it is pointed out and not disputed by the petitioner that the policy under which the tender has been granted contains a grievance redressal mechanism of filing an appeal before the competent authority in the first instance and thereafter a second appeal before the Administrative Secretary, Department of Food, Civil Supplies and Consumer Affairs, Punjab and as the petitioner is required to approach the competent authority by filing an appeal, without entering into the merits of the case and making comments upon the same, we dispose of the writ petition granting liberty to the petitioner to take up all the issues before the competent authority. Mr.
Avinit Avasthi, learned Assistant Advocate General, Punjab, submits that in case the petitioner does so, the appeal shall be considered and decided by the competent authority as expeditiously as possible. AMODH SHARMA 2022.05.
CWP-9347-2022 (O&M) In view of the aforesaid submission made by learned counsel for the petitioner as well as the statement of learned State counsel, the writ petition stands disposed of in terms thereof.
