***** Rajan Gupta, J. (Oral) This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No.112 dated 16.11.2017 under Section 61 of Excise Act, 1914, at Police Station Kot Dharmu, District Mansa.

Learned counsel for the petitioner contends that recovery was effected from the house of Makhan Singh. The prosecution has alleged that all the bottles belong to the petitioner without any evidence. Petitioner is in custody since 16.11.2017. Trial is still at its initial stage and it may take long time to conclude.

Learned State counsel has opposed the prayer for bail. Heard.

Under the circumstances, this court does not intend to express any opinion on the merits of the case. However, keeping in view the period of incarceration and the fact that trial is not likely to conclude at an early date, no useful purpose would be served by detaining the petitioner during Sukhpreet Kaur 2018.01.12 16:29 I attest to the accuracy and integrity of this document

pendency of the trial, I deem it appropriate to grant regular bail to the petitioner. Accordingly, petition is allowed and the petitioner is ordered to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Mansa.
