As per the report of the Registry, notice issued to the sole appellant has been received back with the report that he is residing abroad. 2.

A perusal of the case file demonstrates that on the last date of hearing, i.e. 17.07.2024, learned counsel for the appellant had pleaded no instructions from his client. However, today, despite repeated calls, no one has put in appearance on behalf of the appellant. In such circumstances, no useful purpose would be served by keeping the instant appeal pending on the docket indefinitely.

It appears that the appellant is not interested in pursuing the appeal.

Accordingly, the appeal is dismissed in default for want of prosecution.

However, liberty is granted to the appellant to seek revival of the appeal in case anything worthwhile survives for consideration. 6.
