Present writ petition has been filed under Article 226 of the Constitution, inter alia, seeking directions to the respondents to allow the petitioner to join duties as Inspector, Cooperative Socieities (Personal Assistant to the Deputy Registrar, Cooperative Socieities, Barnala),, which he is not being allowed despite submission of number of respresentations to the respondents No.1, 2 and 4. Further prayer of the petitioner is for setting aside the impugned orders dated 20.1.2022 (Annexure P-11), vide which the petitioner has been declared absent from duty. It is further prayed that adinterim stay on the operation of the impugned summoning orders be granted.
Learned counsel, on instructions from the petitioner, submits that instead of pressing the writ petition on merits at this stage, his client would be satisfied in case, the applications dated 20.12.2021 (Annexure P-8), 21.12.2021 (Annexure P-9) and dated 27.12.2021 (Annexure P-10) pending before the Financial Commissioner, Govt. of Punjab and Registrar, Cooperative Socieities, Punjab, Chandigarh, be considered and decided expeditiously. On the asking of the Court, Mr. Ayush Sarna, AAG, Punjab, accepts notice on behalf of the respondents and states that he has no objection to the prayer of the petitioner to that limited extent. In view of the agreed stand taken by both sides, but without adjudicating the controversy on merits, writ petition is disposed off with direction to respondent No.2- Registrar, Cooperative Socieities, Punjab, Chandigarh to consider and decide the aforesaid applications (Annexures P-8 to P-10), by passing a reasoned order within a period of 06 (six) weeks from the date of receipt of certified copy of this order. Needless to say that, in case there is a failure on the part of competent authority, petitioner would be at liberty to move an appropriate application for revival of this writ petition.
