The petitioner in the year 2000, availed a loan of 2.37 lakhs from Oriental Bank of Commerce for purchase of Tractor. He had not cleared the loan. The claim was raised in writ petition that he was entitled to waiver of loan under 'Agricultural Debt Waiver and Debt Relief Scheme' [hereinafter referred to as 'Scheme'] as notified by the Central Government in the year 2008. The writ petition was disposed of on 22.01.2018. Without expressing any opinion on the merits of the case, the bank was directed to hold a fact finding enquiry and in case petitioner is found entitled to benefit of the Scheme, let the loan account of the petitioner be considered for settlement under the Scheme within a period of three PANKAJ BAWEJA 2019.12.12 09:30 I attest to the accuracy and integrity of this document High Ciourt, Chandigarh
COCP No.1272 of 2019 -2months from the date of receipt of certified copy of order. The present petition is filed pleading wilful disobedience of directions of this Court.
Learned counsel for the respondent submits that to consider the case of the petitioner verification from the Revenue Records was required to be done and for that reason, matter was delayed. He further submits that the said exercise has been completed, the matter is now being put up before the Board of Directors and its meeting is to be held in January, 2020. He states that the order of this Court would be complied with by 28.02.2020. In view of above, no further interference is called for in the contempt proceedings.
The contempt petition is disposed of.
In case needful is not done as per statement made, learned counsel for the petitioner shall be at liberty to revive the contempt petition.
