This is a petition under Section 439 Cr.P.C. seeking regular bail to the petitioner in case FIR No.330 dated 16.9.2020 under Sections 363, 366-A, 420 and 120-B IPC (Sections 376/323 IPC, Section 6 of POCSO Act, and Sections 9 and 10 of the Prohibition of Child Marriage Act, 2006, added later on), registered at Police Station Sadar Fazilka, District Fazilka. Learned State counsel, on instructions from ASI Gurmail Singh, submits that three out of twenty two prosecution witnesses have already been examined, which includes the complainant as well as the prosecutrix, and both of them have not supported the prosecution version. The petitioner is behind bars since 21.2.2021, and there is no other case against the petitioner. In view thereof and realising that conclusion of the trial will take some time, it is deemed appropriate to grant bail to the petitioner. Accordingly, the petition is allowed.
