(Oral) This is a petition for anticipatory bail filed under Section 438 of Cr.P.C., 1973 (Section 482 of Bharatiya Nagarik Suraksha Sanhita, (BNSS), 2023) in FIR No.114 dated 29.08.2022 under Sections 15-B and 29 of the NDPS Act, registered at Police Station Rori, District Sirsa. 2.

The case of the prosecution is that 01 kilo 100 grams of Doda post was recovered from the possession of the co-accused namely Badal who later on during interrogation, suffered disclosure statement and nominated the petitioner in the present case.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. He further contends that besides the disclosure statement made on behalf of the co-accused, no other cogent evidence has come forth to prove the guilt of the petitioner. 3.

This Court, vide order dated 20.03.2025, had directed the petitioner to appear before the Investigating Agency and join investigation and in the event of his arrest, he was ordered to be released on ad-interim bail to the Sonia Puri 2025.07.25 18:32 I attest to the accuracy and integrity of this document

Learned State counsel on instructions from SI Mahender Singh, submits that the petitioner has joined the investigation and is not required for custodial interrogation.

In view of the submissions of learned counsel for the petitioner especially when the petitioner having joined investigation, the order dated 20.03.2025 granting interim bail to the petitioner is made absolute. 6.

However, the petitioner shall abide by the conditions stipulated under Section 482(2) BNSS. He shall also join investigation as and when called upon to do so.

The petition stands allowed.
