******* SURINDER GUPTA, J.(Oral) After arguing for some time, learned counsel for the petitioner seeks permission to withdraw this petition with prayer that petitioner be allowed reasonable time for vacating and handing over the possession of the demised premises to the respondent-landlord. Mr.Kartik Gupta, Advocate, counsel for the caveator, accepts notice on behalf of respondents and agrees with the proposal as put forth by learned counsel for the petitioner to the extent that the respondents have no objection in allowing of time upto 31.12.2019 to the revision petitioner to vacate the demised premises.
In view of submission of learned counsel for the petitioner, this petition is dismissed as withdrawn. To facilitate the revision petitioner to find alternate accommodation, he is allowed period upto JITENDER KUMAR 2019.04.04 16:34 I attest to the accuracy and integrity of this document Chandigarh
CR-2280-2019 -231.12.2019 to vacate and hand over the vacant possession of the demised premises to the respondent-landlord, subject to the following terms:- (i) The petitioner-tenant will pay/deposit the entire due rent/mesne profits upto 30.04.2019 within three weeks. (ii) He will keep on paying/depositing the advance rent/mesne profit of subsequent months upto 31.12.2019 on or before 10th day of each month.
(iii) He will file affidavit before the Executing Court within four weeks giving details of entire payment of rent/mesne profits and undertaking to vacate and hand over the vacant possession of the demised premises to the respondent on or before 31.12.2019. In case of default in compliance of any of the above terms, the respondent-landlord will be entitled to execute the order of ejectment forthwith.
