Through this application, the petitioner (wife) prays for transfer of the proceedings of the petition filed under Section 9 of the Hindu Marriage Act, 1955 (Baljinder Singh v. Amandeep Kaur), presently pending in the Court of the Principal Judge, Family Court, Camp at Payal, District Ludhiana, to the Court of the Principal Judge, Family Court, Camp at Sunam, District Sangrur.

The petitioner claims that the respondent is defending the petition, filed by her, under Section 125 Cr.P.C. at Sunam, District Sangrur and the distance between Payal and Sunam is more than 100 Kms. She has also stated that her father has died, her brother is serving in the Indian Army and there is no male member in the family.

Transfer Application No. 565 of 2021 (O&M) respondent submits that the respondent is willing to live with the petitioner. 4.

Keeping in view the aforesaid facts, the present application is allowed. The proceedings of case Baljinder Singh v. Amandeep Kaur, under Section 9 of the Hindu Marriage Act, 1955, presently pending in the Court of the Principal Judge, Family Court, camp at Payal, District Ludhiana, are transferred to the Court of the Principal Judge, Family Court, Camp at Sunam, District Sangrur. The transferor Court is requested to remit the file of the aforesaid case to the transferee Court forthwith. The parties, through their learned counsel, are directed to appear before the Court of the Principal Judge, Family Court, Camp at Sunam, District Sangrur, on 05.10.2021. The transferee Court is requested to make efforts to reconcile the dispute between the parties.
