RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing FIR No.670 dated 09.12.2009 (Annexure P-1) registered under Sections 379 and 411 IPC at Police Station Sector 34, Chandigarh, on the basis of compromise (Annexure P-2).
Pursuant to the order dated 02.12.2017 of this Court, the parties appeared before the trial Court/Illaqa Magistrate on 11.12.2017 to get their statements recorded. Learned Judicial Magistrate Ist Class, Chandigarh, has submitted his report vide letter bearing No.CJJD-AHL-2017/406 dated 13.12.2017 duly forwarded by learned District and Sessions Judge, Chandigarh vide Endst. No.DSJ-EC-2017/14847 dated 13.12.2017. According to the report, learned Judicial Magistrate Ist Class is satisfied that compromise entered into between the parties is voluntary without any coercion or pressure from any corner and the same is genuine. -2CRM-M-29002 of 2017 dated 13.12.2017 and the fact that the compromise will bring harmony in relations between the parties, FIR No.670 dated 09.12.2009 (Annexure P-1) registered under Sections 379 and 411 IPC at Police Station Sector 34, Chandigarh, is hereby quashed, subject to costs of ` 10,000/- to be deposited with the State Legal Services Authority, U.T., CHandigarh. Petition is disposed of accordingly.
Adjourned to 11.1.2018 with regard to production of receipt of costs deposited by the petitioner.
