The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.234 dated 30.5.2014 (Annexure-P.1) registered for the offence under Section 22 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as `the Act') at Police Station Sadar, Nakodar, District Jalandhar. Notice of motion has been issued in this case. Ms. Shivali, learned Assistant Advocate General, Punjab has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner as well as learned Assistant Advocate General, Punjab appearing for the respondentHarpal Singh Parmar 2016.10.20 11:18 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-29878 of 2016 [2] State and have gone through the record.

From the record, I find that Ranjit Singh was granted bail earlier under Section 167(2) Cr.P.C., but he absented himself to appear before the trial Court on 28.9.2015. He again surrendered before the trial Court and he has been in custody since 5.7.2016. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case. For his absence, he has already suffered a lot by remaining in custody since 5.7.2016. Therefore, keeping in view the facts and circumstances of the present case; this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail by the learned trial Court to its satisfaction October 19, 2016.
