Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail in FIR No.40, dated 09.04.2015, under Sections 420, 465, 467, 468, 471 and 120-B of the Indian Penal Code, 1860, Section 12 of Passport Act, 1967 and Sections 7 and 13(2) of Prevention of Corruption Act, 1988, registered at Police Station City Shaheed Bhagat Singh Nagar, District Shaheed Bhagat Singh Nagar.

Heard.

Petitioner is in custody since 26.06.2015. Challan has already been presented in the Court. Conclusion of trial may take time. The allegation against the petitioner is that he

However, the petitioner had not misused the said passport. Learned counsel for the petitioner has submitted that in fact the petitioner had himself approached the passport authorities for issuance of fresh passport after correcting his name etc.

Learned State counsel, on the other hand, has opposed the petition.

Keeping in view the facts and circumstances of the present case, it would be just and expedient to order the release of the petitioner on bail.

Accordingly, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner be admitted to bail subject to the satisfaction of Chief Judicial Magistrate, Shaheed Bhagat Singh Nagar.
