(ORAL) This is a petition that has been filed under Section 482 Cr.P.C. seeking quashing of Criminal Complaint No. 35/1 dated 12.02.2013 (Annexure P-1) titled as 'Hardeep Kaur vs. Opinder Singh and others' under Sections 406 & 498-A IPC, pending in the Court of learned Sub-Divisional Judicial Magistrate, Balachaur (SBS Nagar) along with all subsequent proceedings emanating therefrom.

Learned counsel for the petitioner herein contends that a complaint had been filed by Hardeep Kaur wife of the petitioner herein against him and his family members. It is argued that the petitioner herein left for Australia in the year 2009. In the meantime, parents of the petitioner faced trial and came to be acquitted of the charges framed against them by the Sub-Divisional Judicial Magistrate, Balachaur by order dated 04.01.2017.

CRM-M-2999-2018 -2In the meantime, the petitioner has returned from Australia and has put in appearance before the trial Court and has also furnished his bail bonds which have been duly accepted by the trial Court. By way of this petition a prayer is made for quashing of the Criminal complaint.

I have heard learned counsel for the petitioner and I am not inclined to grant the prayer made since the petitioner herein has put in appearance before the Sub-Divisional Judicial Magistrate, Balachaur, who is sized of the matter and has already dealt with the issue. Faced with this, learned counsel for the petitioner seeks permission to withdraw the instant petition with a prayer to issue direction to the trial Court that the matter be disposed of expeditiously in a time bound manner.

In view of the fact that the petitioner has put in appearance, the Sub-Divisional Judicial Magistrate, Balachaur is directed to decide the matter expeditiously, preferably within a period of six months. Petition stands disposed of accordingly.
