NIDHI GUPTA, J. (ORAL) Prayer in this 1st petition filed under Section 439 Cr.P.C., is for grant of regular bail to the petitioner in case FIR No.0173 dated 21.06.2023 registered under Sections 363 and 366A IPC and Section 4 of the Protection of Children from Sexual Offences Act, 2012 at Police Station Rampura, Rewari.

Perusal of the file shows that in the memo of parties, it has been mentioned that the petitioner is presently confined in Central Jail, Rewari. However, learned counsel for the State has placed on record a copy of letter No. 811 dated 15.04.2024, as per which the Superintendent, District Prison (Rewari)-Haryana, has informed that the petitioner herein has not been found to be admitted in the said jail in the present FIR.

At this stage, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition. Permitted to do so.

Dismissed as withdrawn.
