*** Learned State counsel states that the petitioner has since joined the investigation and he has furnished an affidavit that he does not hold any Passport. He has also surrendered weapon of offence, therefore, he is not required by the investigating agency in connection with further investigation. Though the injury which had been declared to be grievous is attributed to the petitioner but the said injury is on the non vital part i.e. little finger of right hand.

Under such circumstances, the interim bail granted to the petitioner on 10.8.2017 is made absolute, subject to his fulfilling conditions under Section 438(2) Cr.P.C.

The petition stands allowed accordingly.
