NARESH KUMAR SANGHI, J (Oral) Learned counsel prays for withdrawal of the present petition to enable the petitioner to challenge the impugned summoning order before the Court of Session by way of criminal revision petition, at the first instance.

After hearing learned counsel, present petition is disposed of with a direction that in the event the petitioner prefers criminal revision petition alongwith an application under Section 5 of the Limitation Act, 1963, for condonation of delay in filing criminal revision petition, within one month of passing of this order, the application shall be considered sympathetically keeping in view the fact that the petitioner had approached this Court by way of present petition under Section 482, Cr.P.C.
