ARUN MONGA, J. (ORAL) On 24.10.2001, when the appeal was admitted, following order was passed :

"Admitted.

Recovery against the appellant shall remain stayed provided the appellant furnishes security in the sum of Rs.3,00,000/- to the satisfaction of the trial Court within a period of three months from today. Security shall be accepted after notice to the Municipal Corporation.

Appeal is directed to be listed for final disposal within one year."

When taken up for final hearing today, it transpires that aforesaid order has not been complied with despite a lapse of 22 years. Being so, appeal is dismissed for non-compliance of the order dated 24.10.2001 as well as for non-prosecution. Consequences to follow.
