This petition has been filed under Section 438 Cr.P.C. for the grant of anticipatory bail in case FIR No.463 dated 9.11.2016 registered for the offences under Sections 186, 279, 307, 332, 336, 34, 353 and 427 IPC and Sections 25 and 8 of Arms Act at Police Station Rajendra Park, Gurugram, District Gurugram.

Notice of motion has been issued in this case. Mr. B.S. Virk, learned Deputy Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner and learned State counsel appearing for the respondent-State and have gone through the Harpal Singh Parmar 2017.08.19 15:35 I attest to the accuracy and authenticity of this document Chandigarh

The FIR in the present case has been registered on the basis of a secret information. The present petitioner is not named in the FIR. He is nominated by the co-accused. It has been stated that co-accused had fired from the weapon which was taken from the present petitioner. The present petitioner was not present at the time of occurrence and further it is a no injury case. No useful purpose will be served by sending the petitioner to custody.

In the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I accept this criminal miscellaneous petition and in the event of arrest, the petitioner shall be admitted to bail on his furnishing personal bonds and surety to the satisfaction of the Arresting/Investigating Officer. The petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C.
