IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH.

Crl. Misc. No.M-30040 of 2018 (O&M) Date of Decision: August 07, 2018 Sunit Kaur ......PETITIONER(s).

VERSUS

State of Punjab ....RESPONDENT(s).

CORAM:- HON'BLE MR. JUSTICE SURINDER GUPTA

Present:

Mr. Ashok Giri, Advocate for the petitioner (s).

Mr. Ramandeep S. Sandhu, Sr. DAG Punjab.

******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.67 dated 18.05.2018 registered for the offences punishable under Sections 302, 201 and 120-B of Indian Penal Code, at Police Station Dharamkot, District Moga.

Heard.

Sandeep @ Manjinder Kaur daughter of Swarn Singh was doing a stitching course with Balaji Education Society under the "Skill India Scheme' by Prime Minister and her entire fee was being paid by the Central Government. She attended her course from 15.02.2017 to 12.04.2017 and thereafter, did not attend the institute. Principal of the Society made a call on mobile No.95929-97749 and she was apprised by father of Manjinder

-2Kaur that she had gone abroad and will not attend her course. From 13.04.2017 absence of Sandeep @ Manjinder Kaur was marked in the register. After inquiry made by Principal, Balaji Education Society, father of Manjinder Kaur got recorded her missing report with Police Station Dharamkot vide DDR No.15 dated 24.05.2017. Manjinder Kaur could not be traced and during inquiry proceedings, police receive an information that Swarn Singh, his sons Palwinder Singh Gurwinder Singh, Laddi as well as wife of said Laddi Singh have killed Sandeep @ Manjinder Kaur about 8/9 months before registration of the FIR as she was having illicit relations with some person and disposed of her dead body. Thereafter, they got recorded a missing report and now the entire family has run away leaving the house.

Learned counsel for the petitioner submits that petitioner is wife of Palwinder Singh @ Laddi and has nothing to do with the elopement/murder of Manjinder Kaur. FIR was lodged by the police on the basis of secret information, which has no basis so far. The petitioner is ready to join the investigation and she be extended the benefit of anticipatory bail.

The allegations against the petitioner and her family members are of honour killing. Manjinder Kaur is missing. It is quite strange that she had not attended her institute after 12.04.2017 and missing report regarding her was lodged on 24.05.2017 and that too when Ms. Vandana, Principal of Balaji Education Society made inquiries about her. Even on inquiry, she was told that Manjinder Kaur has gone abroad. This case calls for thorough investigation as it relates to the alleged murder of Sandeep @ Manjinder Kaur by her family members for which custodial interrogation of all the

-3family members is required by the police.

Keeping in view the above facts, nature of offence and conduct of the family members of petitioner, I do not find any reason to exercise the discretionary power of this Court to extend the benefit of anticipatory bail to the petitioner.

This petition has no merits. Dismissed.
