Application stands disposed of.

Main case CRM-M No.20289 of 2021 was dismissed on the ground of concealment of fact vide order dated 21.05.2021.

Even thereafter, CRM-M No.22132 of 2021 filed by the petitioner(s) therein was also got dismissed as withdrawn. On being pointed out by learned counsel for the complainant with reference to vernacular of FIR, it can be seen that khasra No.32(14-19) was mentioned in the FIR, in which minor operations were being done by the accused. That fact was corroborated by different reports of revenue officials/officers. While translating the FIR, the petitioner has concealed the allegations of mining in different khasra numbers including khasra No.32(14-19) belonging to the Gram Panchayat. Petitioner was successful in getting the order dated 17.05.2021 by way of concealment of aforesaid fact.

It appears that a crude attempt has been made to mislead the Court by not mentioning even single khasra number in true translation of the FIR.

This petition requires to be dealt with at par with CRM-M No.20289 of 2021, which has already been dismissed on the ground of concealment.

Learned counsel for the petitioner seeks to address arguments on other grounds to show his bona fide. A person who conceals material facts from the Court, does not deserve any sympathetic consideration. In view of aforesaid position, this petition is dismissed

on the ground of concealment without making any further reference.
