***** HARI PAL VERMA, J. (Oral) Prayer in the present petition filed under Section 439 of the Code of Criminal Procedure, 1973 is for grant of regular bail to the petitioner in case FIR No.23 dated 12.02.2017 under Section 411 IPC registered at Police Station Jaitu, District Faridkot. Learned counsel for the petitioner has argued that vide order dated 02.11.2019, the petitioner was declared as proclaimed offender for being absent from the Court, otherwise, he was on bail. However, the petitioner has surrendered before the Court in March 2020 and since then, he is in custody. He submits that the petitioner shall continue to appear before the Court if he is released on bail.

Criminal Misc. No.M-15551 of 2020 -2Learned State counsel does not dispute the custody of the petitioner.

I have heard learned counsel for the parties. Admittedly, the petitioner was on bail, however, on one date, he could not appear before the Court and it is for this reason, he was declared as proclaimed offender, though later on, he surrendered before the Court and taken into custody. Considering the fact that trial in the case will take sufficient long time and no useful purpose would be served by keeping the petitioner in custody, this Court deems it appropriate to release the petitioner on regular bail.

Accordingly, the present petition is allowed and the petitioner is admitted on regular bail, subject to furnishing of his bail bonds/surety bonds to the satisfaction of trial Court/Duty Magistrate. However, the petitioner shall continue to appear before the trial Court.
