******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No. 148 dated 01.06.2017 registered for the offences punishable under Sections 420, 468, 471 and 506 of Indian Penal Code, at Police Station Civil Lines, Bhiwani.
Heard.
A draft of `2 lakh has been handed over by learned counsel for the petitioner to learned counsel for the complainant. It has been mutually settled by the parties that the petitioner will pay the remaining payment of `21,50,000/- in installments by paying `4 lakh after every two months. CRM-M-29125-2017 -2first installment of `4 lakh will be paid before 10th of January, 2018 and the remaining payment will be made on or before 10th of each alternate month. Last installment will be of entire remaining amount and the payment will be made either in the account of the complainant or shall be paid to him by way of demand draft in his name.
In view of the settlement between the parties but without expressing any opinion on merits of the case, the present petition is allowed. Interim order dated 22.08.2017 is made absolute, subject to following terms:- a. The petitioner shall comply with the conditions mentioned in Section 437(3) Cr.P.C.
b. In the event of his absence on any date of hearing, the benefit of bail allowed to the petitioner shall stand withdrawn. The trial Court shall be competent to cancel his bail bond and surety bond and proceed to procure his presence in accordance with law. In that eventuality the petitioner shall have to apply for bail afresh.
c. He shall not leave the country without the prior permission of the Court.
d. In the event of failure of petitioner to pay any of the installment in time, the benefit of regular bail shall stand withdrawn and he will be taken into custody.
