RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Paramjit Singh @ Mintu @ Mithu in a case arising from FIR No.103 dated 10.08.2017 registered under Sections 15/29/61/85 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Pasiana, District Patiala (Punjab). According to the prosecution, on 10.08.2017, the police party was present at Village Kakrala and laid a barrier. They stopped a Maruti Swift car for checking being driven by the petitioner. One Simranjit Singh @ Rikki was sitting on the front seat. Upon search, recovery of 100 kilograms (one quintal) poppy pods was effected from them. Therefore, present FIR was lodged against them.

During investigation, two more persons namely Surjit Singh and Manjit Kaur were also found involved. Learned counsel for the petitioner inter alia contends that the petitioner has been falsely implicated in the present case and is behind bars Ravinder Singh 2018.07.26 15:06 I attest to the accuracy and authenticity of this document since 10.08.2017. No other case is pending against the petitioner.

-2CRM-M-30066 of 2018 Singh @ Rikki have already been granted regular bail by this Court. The conclusion of trial will take a long time. No useful purpose would be served by detaining the petitioner in jail.

On the other hand, learned State counsel has vehemently opposed the bail application.

Considering overall facts and circumstances and treating the case of the petitioner on the same parity as that of his co-accused, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
