The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking directions to the respondents to renew/re-issue passport in view of notification dated 25.08.1993. 2.

The petitioner was issued passport on 09.12.1996 which was valid upto 08.12.2006. On 10.03.2017, the petitioner applied for re-issuance of passport, however, he was informed that he should get permission from Court.

The petitioner was convicted by judgment dated 04.02.2015. The petitioner preferred an appeal before Appellate Court which came to be dismissed and thereafter, the petitioner preferred CRR No.845 of 2015 before this Court. This Court vide order dated 17.07.2015 suspended sentence of the petitioner.

Learned counsel for the petitioner inter alia contends that sentence of the petitioner was suspended on 17.07.2015, thus, the case of the petitioner is not covered by either clause (e) or (f) of Section 6 (2) of Passport Act. The case of the petitioner is squarely covered by judgment dated 14.07.2023 passed by this Court in CWP No.27167 of 2018. 5.

Ms. Saigeeta Srivastava, Advocate for the respondent does not dispute the fact that the case of the petitioner is squarely covered by aforesaid judgment of this Court.

The petition stands disposed of with a direction to the respondents to decide application of the petitioner, in view of judgment dated 14.07.2023 passed by this Court in CWP No.27167 of 2018, within 08 weeks from today.
