ARUN MONGA, J. (ORAL) Petitioner herein, inter alia, seeks quashing of final result (Annexure P-12) as the same has been declared without considering the petitioner in DESM SC category. Further prayer has been made to select the petitioner for the post of MPHW (F) qua category No.4 in the selection initiated as a result of advertisement dated 07.09.2019 (Annexure P-3).

Petitioner is married daughter of an ex-serviceman. She was married on 19.12.1999 and her father died on 08.01.2019. The petitioner successfully completed diploma from Bharat School of Nursing, Kurukshetra. She was registered as Multi Purpose Health Worker (F) on 15.01.2014 (Annexure P-2). There were 565 posts of MPHW (F) under various categories. Being eligible, petitioner applied for the said post under SC category. She appeared in the written examination on 25.07.2021. At the time of scrutiny of documents, petitioner gave an undertaking dated 27.10.2021 (Annexure P-7) that no one in her family is in government job. She also submitted experience certificates as she was working on contract as ANM since 19.06.2014. Final result was declared on 18.02.2022. The last selected candidate in SC category scored 57 marks and in ESM SC category scored 52.50 marks. requisite Ex-Serviceman Dependent Certificate with a request to consider her candidature in DESM SC category but to no vain. 3.

Petitioner also submitted representation dated 04.03.2022 (Annexure P-19) but the same has not been adverted till date. Hence the petition.

On advance service, learned State counsel appears and submits that a decision will be taken by competent authority, either way, on the pending representation dated 04.03.2022 (Annexure P-19) by passing a speaking order.

At this stage, learned counsel for the petitioner also seeks decision on the pending representation as suggested by learned state counsel.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the instant writ petition is disposed of with a direction to the respondents to look into the representation dated 04.03.2022 (Annexure P-19) of the petitioner and pass an administrative order, in accordance with law. 8.

Let the needful be done within a period of 30 days. 9.

Disposed of accordingly.
