RAMENDRA JAIN, J. (ORAL) Through this petition under Section 439 Cr.P.C., petitionerAmit, has prayed for grant of regular bail in case FIR No. 312 dated 07.11.2017 registered under Sections 307, 341 and 120-B IPC; Section 25 of the Arms Act and Section 3 of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 at Police Station Adampur, District Hissar.

The petitioner is facing trial in the aforesaid FIR, on the allegations that on 06.11.2017, he along with his accomplice fired upon complainant-Manish, with intention to murder him. Learned counsel for the petitioner by placing on record certified copies of statements of complainant-injured-Manish @ Dhillu and Hanuman, appeared as PW4 and PW-5, respectively, contends that both the material witnesses have turned hostile. CRM-M-15496-2019 -2since 23.11.2017. Conclusion of trial may take a long time. No useful purpose would be served by detaining him in jail. On the other hand, learned State counsel vehemently opposed the submissions of learned counsel for the petitioner. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner-Amit, is ordered to be released on bail pending trial, on his furnishing adequate bail and surety bonds to the satisfaction of trial Court/Duty Magistrate, concerned.
