Present petition under Section 482 Cr.P.C. for quashing of order dated 28.2.2017 (Annexure P6), passed by the Court of learned Judicial Magistrate Ist Class, Amritsar whereby defence of the petitioner was closed by the Court order and order dated 12.7.2017 (Annexure P8), passed by the learned Additional Sessions Judge, Amritsar, whereby revision petition was dismissed.
Learned counsel for the petitioner has fairly conceded that some adjournments were sought to lead defence evidence and thereafter, another request for adjournment was made as there was change of counsel. Having considered the matter in its entirety and perusal of record, this Court is of the considered view that in the present case statement of accused under Section 313 Cr.P.C. was recorded on 11.11.2016 and thereafter the case was repeatedly adjourned for leading defence evidence Deepak Kumar Bhardwaj 2017.08.25 13:16 I attest to the accuracy and integrity of this document for three years after availing repeated adjournments, request was again made
Criminal Misc. No. M-29188 of 2017 for one more opportunity which was declined by learned Magistrate vide order dated 28.2.2017. Revision petition filed against the said order was dismissed by the learned Additional Sessions Judge on 12.7.2017. There is absolutely no illegality in the orders passed by the learned Courts below. Resultantly, the present petition lacks merits and stands dismissed.
