CRM-M-30062-2016 In this second petition filed under Section 439 Cr.P.C., the petitioner seeks his release on interim bail in case FIR No.92, dated 03.06.2014, under Sections 21/22/25/25(A)/27/27(A)/29/61/85 of the Narcotic Drugs and Psychotropic Substances Act, 1985 read with Section 25/54/59 of Arms Act, 1959, registered at Police Station Pasiana, District Patiala on the ground that his father, who used to reside in Canada unfortunately passed away on 10.08.2016 in that country and his Bhog Ceremony is being organized in the petitioner's parental village on Meenu 2016.09.21 16:49 I attest to the accuracy and authenticity of this document chandigarh

It does appear from the documents relied upon by petitioner that his father died and was cremated in Canada. Some of his family members have now come to India to perform Bhog Ceremony. We,thus without expressing any view on merits, allow this petition and direct the petitioner's release on interim bail from 22.09.2016 to 30.09.2016 subject to his furnishing bail bonds to the satisfaction of CJM/Duty Magistrate, Patiala. He shall also deposit/surrender his passport, if already not done. Petitioner shall be released by tomorrow and is directed to surrender on 30.09.2016 before 4.00 p.m.
