Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.34 dated 27.02.2013 under Sections 302, 307, 427, 506, 148, 149 and Sections 25 and 27 of the Arms Act, registered at Police Station Mataur, District Mohali. Notice of motion.
Mr.Gaurav Garg Dhuriwala, Sr.DAG, Punjab, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. It has been brought to the notice of this Court that trial is already complete and case is fixed for defence evidence since 2015. Learned counsel for the petitioner prayed for parity as co-accused Jaswinder Vineet Gulati 2017.08.30 14:22 I attest to the accuracy and authenticity of this document Chandigarh Singh alias Khattu has been granted bail in this case.
CRM No.M-29216 of 2017 -2Learned State counsel submitted that when Jaswinder Singh alias Khattu was granted bail, at that time, there was stay on proceedings by this Court. Now, no stay order is in operation. He also submitted that this Court has already given the direction to the trial Court to decide the case expeditiously.
In view above submissions and also in view of the fact that trial is already complete and the case is fixed for defence evidence since 2015, I do not find any ground to grant regular bail to the petitioner. Therefore, finding no merit in the present petition, the same is dismissed.
