Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in FIR No.38 dated 16.06.2015 under Section 420 IPC, registered at Police Station City-II, Mansa. Notice of motion was issued and learned State counsel appeared and contested the petition.

The FIR in the present was registered on the basis of the statement of Sukhwinder Singh. The main allegations are against Pritpal Singh regarding cheating the complainant on the ground of sending him to foreign country. It is also allegation in the FIR that `4.50 lacs in cash and documents were given. CRM No.M-29169 of 2015 -2accused obtained signatures and Harpreet Kaur took `4.50 lacs from complainant side and after counting the same, put the same in bag with her.

At the time of argument, learned State counsel after verifying from the Investigating Officer, contended that except this averment in the FIR, no document has been collected against the present petitioner of any type showing her direct involvement in the case. Pritpal Singh is stated to have already been arrested in the present case.

Keeping in view the facts and circumstances of the case and without discussing the merits of the case in minute details and without expressing any opinion on the merits of the case, I find it a fit case where petitioner is entitled to benefit of grant of anticipatory bail. Therefore, present petition stands allowed. It is ordered that in the event of arrest, the petitioner be released on anticipatory bail subject to her furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438 (2) Cr.P.C.
