Mr. Shubham Goyal, Advocate for the complainant. ***** GURVINDER SINGH GILL, J .(Oral) The learned State counsel has informed that as on date only one prosecution witness namely ASI Sukhchain Singh, the Investigating Officer, remains to be examined.

The learned State counsel, upon instructions from ASI Joginder Singh, who is present in person, has informed that the aforesaid official is presently posted in Amritsar.

ASI Sukhchain Singh is directed to positively appear before the Trial Court on the next date of hearing fixed before the Trial Court i.e. 9.12.2019 for the purpose of getting his statement recorded. ASI Joginder Singh, who is present in person, shall inform ASI Sukhchain Singh about the order passed by this Court to the effect that he is PANKAJ KAKKAR 2019.11.26 11:15 I attest to the accuracy and integrity of this document

Faced with the aforesaid position, the learned counsel for the petitioner submits that he may be permitted to withdraw the present petition. In view of the aforesaid submission, the present petition is dismissed as withdrawn.

The petitioner would be at liberty to file a fresh petition for grant of regular bail in case there is inordinate delay in the conclusion of trial.
